El Colegio de Abogados de Lima Este, ante los graves hechos acontecidos \u00e9ste 12 de abril de 2026, en el marco de las trascendentales elecciones generales, que impidieron que miles de ciudadanos pudieran ejercer su derecho al voto, ante el retraso y no instalaci\u00f3n de las mesas de sufragio a cargo de la ONPE, expresa lo siguiente:<\/p>\n\n\n\n

  1. La Constituci\u00f3n Pol\u00edtica consagra en su art. 2\u00b0 numeral 17, que toda persona tiene \u201cderecho a participar en forma individual en la vida pol\u00edtica, Los ciudadanos tiene conforme a ley los derechos de elecci\u00f3n. Asimismo, el art. 31\u00b0 consagra el derecho inalienable e irrestricto a todos los peruanos y peruanas \u201cde ser elegidos y de elegir libremente a sus representantes\u2026\u201d<\/li>\n\n\n\n
  2. Que, el Art 176\u00b0 de nuestra Carta Magna, indica que el sistema electoral tiene por finalidad asegurar que las votaciones traduzcan la expresi\u00f3n aut\u00e9ntica, libre y espont\u00e1nea de los ciudadanos y que los escrutinios sean reflejo exacto y oportuno de la voluntad del elector expresada en las urnas por votaci\u00f3n directa.<\/li>\n\n\n\n
  3. Las graves conductas de negligencia e irregularidades en la instalaci\u00f3n de las mesas de sufragio, por el retraso y no instalaci\u00f3n de las mismas, originadas por las acciones deficientes y punibles de funcionarios de la ONPE, merece el rechazo un\u00e1nime de toda la ciudadan\u00eda.<\/li>\n\n\n\n
  4. El mandato constitucional se ha quebrado por negligencia punible del jefe de la ONPE, se\u00f1or Piero Corvetto y los funcionarios responsables de organizar el proceso electoral referido, para lo cual contaban con todos los elementos legales, presupuestarios y log\u00edsticos que dicha labor requiere, por lo que su grave e injustificado incumplimiento gener\u00f3 que el material electoral en cientos de locales de votaci\u00f3n de Lima Metropolitana no llegara. Atentar contra el derecho fundamental al voto, merece la m\u00e1xima sanci\u00f3n no solo de orden administrativo sino tambi\u00e9n penal.<\/li>\n\n\n\n
  5. En tal contexto, respaldamos la denuncia penal contra el jefe de la ONPE, formulada por el Procurador Publico del Jurado Nacional de Elecciones, por los delitos contra el derecho de sufragio, omisi\u00f3n, rehusamiento o demora de actos funcionales y obstaculizaci\u00f3n del normal desarrollo del acto electoral, ; instamos la intervenci\u00f3n del Ministerio Publico para que prontamente act\u00fae conforme a sus atribuciones.<\/li>\n\n\n\n
  6. De igual forma instamos a la Junta Nacional de Justicia a que proceda con prontitud a culminar con la Investigaci\u00f3n preliminar aperturada en contra del jefe de la ONPE, dada su grave negligencia e ineficiencia en el ejercicio de sus funciones, que deber\u00eda culminar con el debido proceso con la m\u00e1xima sanci\u00f3n de destituci\u00f3n.<\/li>\n\n\n\n
  7. Finalmente, EXIGIMOS al se\u00f1or Piero Corvetto, jefe de la ONPE, la renuncia inmediata a su cargo, a fin de garantizar que las funciones de dicha entidad, se realicen con eficiencia, oportunidad, transparencia y con pleno respeto del derecho fundamental al sufragio de peruanos y peruanas.<\/li>\n<\/ol>\n\n\n\n
